The legal basis for a fair, transparent and trusting relationship at Benny Dance.

The following General Terms and Conditions (hereinafter "Terms") regulate the contractual relationship between Benny Dance (hereinafter "the Studio") and the member, in accordance with the Civil Code (BGB). The philosophy of Benny Dance prioritizes transparency, fairness and customer satisfaction.

1. Membership models and prices

Benny Dance offers the following membership models, designed for different commitment and flexibility needs:

2. Service promise and class schedule

Service guarantee: Unlike other dance schools, Benny Dance commits to maintaining regular class operation or an alternative program during the 52 weeks of the year, including legal holidays, to guarantee maximum availability.

Instructor absence: In case of an instructor absence, the Studio guarantees service provision through a substitute, an online offer or a make-up class.

3. Cancellation rights and early termination

Our cancellation conditions seek a fair balance between the contractual commitment and the unforeseen circumstances of our members:

Special cancellation for justified cause: We understand that unforeseen and serious situations may arise (such as a prolonged injury or illness, pregnancy or a move to a city outside our coverage area). In these cases, the contract can be cancelled early by submitting the corresponding official or medical proof, without retroactive adjustments to the flexible rate price. This cancellation takes effect with one (1) calendar month notice. This means the contract ends at the end of the month following the cancellation and the member is exempt from additional payments for the rest of the contractual period.

Ordinary cancellation / without justified cause: If the member cancels early without a legally recognized serious reason (according to BGB), the member remains obliged to pay the agreed fees until the end of the contractual period.

4. Fees and administrative costs

Benny Dance charges administrative fees strictly based on real costs, to avoid disproportionate surcharges:

  • Activation fee: A one-time activation fee is paid upon first registration.
  • Card loss or reactivation: A fee of 5.00 EUR is charged for replacing the physical member card or reactivating the access code.
  • Direct debit return costs: In case of a direct debit return attributable to the member (e.g. insufficient funds), a processing fee of 5.00 EUR is charged to cover actual bank costs.
  • Reminder fees: A flat fee of 1.00 EUR is charged for each payment reminder/formal notification sent (from the moment of non-payment).

5. Right of withdrawal and value compensation

Legal 14-day withdrawal period: In distance contracts (online), the member has the right to withdraw from the contract within 14 days.

Early start and value compensation: If the member expressly requests (e.g. by checking a box in the registration process) that the service begins before the 14-day withdrawal period and subsequently exercises the right of withdrawal, the member is legally obliged to pay a value compensation for the services provided up to the withdrawal. This compensation is calculated strictly in proportion to the value of the classes used (example: if the rate includes 4 classes and 2 were attended before the withdrawal, 50 % of the monthly fee is paid).

6. Special introductory promotion

"First month free": This promotion is exclusive to members who sign up for the annual rate (39.99 EUR). To ensure the validity of the contract, the member pays the first month fee (39.99 EUR). This amount is fully offset or refunded with the payment of the second month.

Legal condition: By taking advantage of this promotion for the annual rate, the member acknowledges that if the right of withdrawal is exercised within 14 days, the value compensation rule (see point 5) applies fully to the classes already taken.

7. Intellectual property and recordings

Choreographies: The reproduction, distribution or commercial use of the choreographies and concepts taught in the classes without prior written consent of the Studio is expressly prohibited.

Recordings by the Studio: The Studio is authorized to make photographic and video recordings of the classes for promotional purposes. The member retains at all times the right to object to the recording of their person (opt-out).

Recordings by members: To protect the privacy of all members and avoid legal claims, it is strictly prohibited for members to make their own recordings (videos or photos) during classes.

8. Absence and force majeure

Member absence: Non-participation in classes for personal reasons (vacation, work reasons, mild illness, etc.) does not exempt from the payment obligation and gives no right to a refund.

Force majeure: If the Studio must temporarily suspend operations due to force majeure (e.g. official orders related to a pandemic), the contract is paused at no cost. The duration of this pause is added in full to the end of the regular contractual period.
